Chapter 1 General Provisions
Article 1: In accordance with Article 17 of the Law of the People's Republic of China on the Exit and Entry Administration of Citizens, these Measures are formulated.
Article 2: These measures apply to mainland citizens traveling to and from Hong Kong (hereinafter referred to as Hong Kong) or Macau (hereinafter referred to as Macau) for personal matters, as well as Hong Kong and Macau compatriots traveling to and from the mainland.
Article 3: Mainland citizens who travel to Hong Kong and Macao for personal matters shall pass through designated ports with the Travel Permit to Hong Kong and Macao or the Exit Entry Permit to Hong Kong and Macao issued by the Chinese public security organs; Returning to the mainland can also be accessed through other ports open to the outside world. Designated ports: Shenzhen for Hong Kong and Gongbei for Macau.
Article 4: Compatriots from Hong Kong and Macao who travel between Hong Kong, Macao and the mainland shall use the Hong Kong and Macao Compatriot Return Permit or Exit Entry Permit issued by the public security organs of China to pass through the ports opened to the outside world in China.
Chapter 2: Mainland Citizens Going to Hong Kong and Macau
Article 5: Mainland citizens settling in Hong Kong and Macau for personal matters shall be subject to quota approval in order to maintain and preserve the economic prosperity and social stability of Hong Kong and Macau.
Article 6: Mainland citizens who travel to Hong Kong or Macau for personal matters must apply to the exit and entry management department of the city or county public security bureau where their household registration is located.
Article 7: Those who fall under any of the following circumstances may apply to settle in Hong Kong or Macau: (1) One spouse has settled in Hong Kong or Macau and has been separated for many years; (2) Parents who settle in Hong Kong or Macau are elderly and weak, and must be taken care of by mainland children; (3) Elderly and children in mainland China who have no one to rely on must seek refuge with their immediate and close relatives in Hong Kong and Macau; (4) The property of direct relatives who have settled in Hong Kong or Macau cannot be inherited and must be settled by mainland children in order to inherit it; (5) There are other special circumstances that require settling down.
Article 8: Those who have one of the following circumstances may apply for short-term travel to Hong Kong or Macau: (1) close relatives who have settled in Hong Kong or Macau and need to visit them; (2) Direct relatives or close relatives who are Taiwanese compatriots must go to Hong Kong or Macau to meet relatives from mainland China; (3) The immediate family members, brothers and sisters of returned overseas Chinese and the immediate family members of the family members of overseas Chinese who cannot return to the mainland to visit their relatives must go to Hong Kong and Macao to meet; (4) Must go to Hong Kong and Macau to handle industries; (5) There are other special circumstances that require short-term travel to Hong Kong and Macau.
Article 9 Mainland citizens who apply for going to Hong Kong or Macao for private affairs must answer relevant inquiries and go through the following procedures: (1) hand in the household examination booklet or other registered residence certificates; (2) Fill out the application form; (3) Submit the opinions of the employer on the applicant's travel to Hong Kong and Macau; (4) Submit proof corresponding to the reason for the application.
Article 10: The proof referred to in Article 9, Item 4 of these Measures refers to: (1) for the reunion of spouses, a legal marriage certificate must be submitted, as well as proof that the spouse has permanent residency in Hong Kong or Macau; (2) To take care of elderly and weak parents, or elderly and children who have no one to rely on and seek refuge with relatives in Hong Kong or Macau, proof of their relationship with relatives in Hong Kong or Macau and their permanent residency in Hong Kong or Macau must be submitted; (3) To inherit or handle an industry, proof of the industry status and legal inheritance rights must be submitted; (4) Visiting relatives in Hong Kong and Macau requires submitting a letter from the relatives; If time is urgent, relevant explanations or proofs related to the application reasons should be submitted as much as possible; (5) To meet with relatives in Taiwan or relatives residing abroad, accurate proof of the date of arrival of the relatives in Hong Kong or Macau must be submitted.
Article 11: The exit and entry management department of the public security organs shall make a decision of approval or disapproval within 60 days of accepting an application to go to Hong Kong or Macau, and notify the applicant.
Article 12: Mainland citizens who have been approved to settle in Hong Kong and Macao shall be issued a travel permit to Hong Kong and Macao by the exit and entry management department of the public security organs. The holder shall cancel their household registration at the local police station before going to Hong Kong or Macau, and go to Hong Kong or Macau within the prescribed time. Mainland citizens who have been approved to travel to Hong Kong and Macau for a short period of time will be issued a travel permit for traveling to and from Hong Kong and Macau. The certificate holder shall go and return on schedule within the prescribed time.
Article 13: Mainland citizens who apply to go to Hong Kong or Macau shall not be approved if they fall under any of the following circumstances: (1) those specified in Article 8 of the Exit and Entry Administration Law of the People's Republic of China; (2) Not falling under the circumstances stipulated in Articles 7 and 8 of these Measures; (3) Fabricating situations, providing false certificates, and deceiving the entry and exit management departments of public security organs.
Chapter 3: Compatriots from Hong Kong and Macao Coming to the Mainland
Article 14: Compatriots from Hong Kong and Macao who come to the mainland must apply for and obtain a Hong Kong and Macao Compatriot Return Permit. The Hong Kong and Macao Compatriots' Home Return Permit is issued by the Guangdong Provincial Public Security Department. To apply for a Hong Kong and Macau Compatriot Homecoming Permit, one must provide proof of residence and fill out an application form. Compatriots from Hong Kong and Macao who do not frequently come to the mainland can apply for an entry and exit permit. The application method is the same as applying for the Hong Kong and Macao Compatriots' Home Return Permit.
Article 15: In any of the following circumstances, Hong Kong and Macao compatriots shall not be issued a home return permit or an entry and exit permit: (1) those who are considered to be likely to engage in criminal activities such as robbery, theft, drug trafficking, etc; (2) Fabricating situations and submitting false certificates; (3) Psychiatric patients.
Article 16: Compatriots from Hong Kong and Macao who drive motor vehicles to the mainland shall apply for a driving license in accordance with relevant regulations of the Guangdong Provincial People's Government. Drivers must also apply for permission to drive Hong Kong and Macao motor vehicles to and from the mainland from the Exit and Entry Administration Department of the Guangdong Provincial Public Security Department.
Article 17: Compatriots from Hong Kong and Macao who come to the mainland for a short period of time shall apply for temporary residence registration in accordance with the household registration management regulations. For accommodation in hotels, restaurants, inns, guesthouses, schools and other enterprises, institutions or government agencies, groups and other institutions, a temporary accommodation registration form shall be filled out; For those who live in the home of relatives and friends, they or their relatives and friends shall go to the local police station or registered residence office to register for temporary residence within 24 hours (or 72 hours in rural areas).
Article 18: Compatriots from Hong Kong and Macao who request to settle in the mainland shall apply to the public security bureau of the city or county where they intend to settle in advance. After approval, they shall bring their Hong Kong and Macao Compatriots' Home Return Permit with a Home Return Settlement Visa to the place of settlement to complete the permanent household registration procedures.
Chapter 4: Exit Entry Inspection
Article 19: Mainland citizens traveling to and from Hong Kong and Macao, as well as Hong Kong and Macao compatriots traveling to and from the mainland, shall present their entry and exit documents to the border inspection stations at open ports or designated ports, fill out and submit their exit and entry registration cards, and undergo inspection.
Article 20: In any of the following circumstances, border inspection stations have the right to prevent the exit or entry of individuals: (1) those who do not hold a travel permit for Hong Kong and Macao, a Hong Kong and Macao compatriot return permit, or other valid documents; (2) Holding forged, altered or other invalid travel documents for entering and leaving Hong Kong and Macao, or returning home permits for Hong Kong and Macao compatriots, and impersonating others' travel documents for entering and leaving Hong Kong and Macao or returning home permits for Hong Kong and Macao compatriots; (3) Refusing to submit documents for verification. Those who fall under the circumstances specified in the second item of the preceding paragraph may also be dealt with in accordance with the provisions of Article 26 of these Measures.
Chapter 5: Document Management
Article 21: The Hong Kong and Macao Compatriots' Home Return Permit shall be kept by the holder, with a validity period of ten years, and can be used multiple times during the validity period. If the validity period has expired or the inspection pages have been used up, a new certificate can be issued. The application for a new certificate shall be processed in accordance with Article 14 of these Measures.
Article 22: The travel permit to Hong Kong and Macau is valid for one use within its validity period. The validity period of the Hong Kong and Macau Travel Permit is five years, and it can be extended twice, each time not exceeding five years. The certificate shall be kept and used by the holder, and the application procedures for each trip to Hong Kong and Macau must be handled in accordance with the provisions of Article 6, Article 8, and Article 10 of these Measures. If approved, a round-trip visa shall be issued. Public security organs specially authorized by the Ministry of Public Security may issue multiple entry and exit visas.
Article 23: If Hong Kong and Macao compatriots lose their Hong Kong and Macao Compatriots' Home Return Permit after coming to the mainland, they shall report the loss to the public security organs of the city, county or transportation department where it was lost. After investigation by the public security organs, a certificate shall be issued, and a valid entry and exit permit shall be issued by the exit and entry management department of the public security organs. The certificate shall be returned to Hong Kong and Macao. Compatriots from Hong Kong and Macau who have lost their Hong Kong and Macau Compatriots' Home Return Permit in Hong Kong, Macau, or mainland China may reapply for it in accordance with Article 14 of these Measures.
Article 24: Mainland citizens who lose their travel permits to and from Hong Kong and Macao before going to Hong Kong or Macao shall immediately report to the original issuing authority and have themselves declare in a newspaper. If the investigation is true, the documents shall be reissued.
Article 25: If the holder of the Hong Kong and Macao Compatriots' Home Return Permit falls under any of the circumstances stipulated in Article 15 of these Measures, the certificate shall be revoked. Revocation of certificates shall be decided and confiscated by the original issuing authority or its superior authority.
Chapter 6 Punishment
Article 26: Those who hold forged, altered or other invalid travel permits to Hong Kong and Macao, travel permits to and from Hong Kong and Macao, Hong Kong and Macao compatriots returning home permits, or entry and exit permits of others shall, in addition to having their documents confiscated, be given a warning or detention for up to five days depending on the severity of the circumstances.
Article 27: Those who forge, alter, or transfer travel permits to Hong Kong and Macao, travel permits to and from Hong Kong and Macao, return permits for compatriots from Hong Kong and Macao, or entry and exit permits shall be detained for no more than ten days; If the circumstances are serious and constitute a crime, criminal responsibility shall be pursued in accordance with the relevant provisions of the Criminal Law of the People's Republic of China.
Article 28: Those who fabricate information, provide false certificates, or use bribery or other means to obtain travel permits to Hong Kong and Macao, entry and exit permits for Hong Kong and Macao compatriots, return permits for Hong Kong and Macao compatriots, or entry and exit permits, and the circumstances are relatively minor, shall be given a warning or detained for up to five days; If the circumstances are serious and constitute a crime, criminal responsibility shall be pursued in accordance with the relevant provisions of the Criminal Law of the People's Republic of China.
Article 29: If staff members of public security organs use their powers to solicit, accept bribes, or engage in other illegal or negligent acts during the implementation of these Measures, and the circumstances are minor, they may be subject to administrative sanctions at the discretion of the competent department; If the circumstances are serious and constitute a crime, criminal responsibility shall be pursued in accordance with the relevant provisions of the Criminal Law of the People's Republic of China.
Chapter 7 Supplementary Provisions
Article 30: These Measures shall be implemented and interpreted by the Ministry of Public Security.
Article 31: These Measures shall come into effect from the date of promulgation.
